In the story Mrs. Bixpy and the Colonels Coat, an example of where justice is served to an unjust character is Mrs. Bixpy. She is having an affair with the Colonel. She would tell her husband that she was seeing her aunt in Ireland but she would actually go see the Colonel. He gives Mrs. Bixpy a very expensive mink coat as he tells her that their relationship has to come to an end. In order to get the coat with out any suspicion from her husband, she pawns it. She then tells her husband that she found a ticket from the pawn shop and for him to go see what the ticket is for. Just as she thought that her plan of manipulation and deception of her husband had worked, it took a turn for the worse for Mrs. Bixpy. Her husband handed her a very cheap stole, not her very expensive mink coat. Mrs. Bixpy knew something was off when she passed by her husbands secretary. Isn ? t it s gorgeos day? Miss Pulteney said as she went by, flashing a smile. There was a lilt in her walk, a little whiff of perfume attending her, and she looked like a queen, just exactly like a queen in the beautiful black mink coat that the Colonel had given to Mrs Bixby(Dahl Vol. 1 63). Mrs. Bixpy began to put all the pieces together and she realized that her husband was cheating on her. This is a surprise to Mrs. Bixpy because she thought that she was the one that was being clever. She then realizes that she was getting just as manipulated as she was to her husband. Justice was served in that Mrs. Bixpy realized that she was getting cheated on just as she had cheated on her husband. Lionel Lampson in the story Nunc Dimittis seeks to serve justice through revenge. Gladys Ponsonby had told Lionel that his girlfriend, Janet de Pegalia, had called him a crashing boar. Lionel was very upset with this news. In order to get back at her, he gets John Royden to paint a picture of her. Because he paints in layers, Lionel is able to remove the paint in order to make her naked. Lionel said, It was truely an astonishing sight! This woman, Janet de Pelagia, almost life size, standing in her underwear ? in a sort of drawing? room, I supose it was ? with a great chandelier above her head and a red? pluch chair by her side; and she herself ? this was the most disturbing part of all ? looking so completely unconcerned. (Dahl Vol. 2 93) To get back at her, he nvites all of his friends and family over, including Janet. He hung up the picture of her naked for all to see it to get revenge at her and to do what he sees as justice. Janet de Pagalia decides to get revenge on Lionel and to do what she sees as justice. She mails him a jar of his favorite food, caviar. It is hinted at that she poisoned the caviar when Lionel said that he was not feeling well. The title o f the short story Nunc Dimittis is Latin. Translated, it means now you dismiss. Dahl intended to use this title as it is an allusion to a story in the Bible. It is a reference to the Canticle of Simeon in which God tells Simeon that he would not not die until he had seen the messiah. When Mary and Joseph bring him Jesus, Simeon said Lord, now you dismiss your servant; go in peace(International Student Bible for Catholics Luke 2:29-32 ) The reason why Dahl used this title Nunc Dimittis was to hint at that there was going to be death in the story. From the readers point of view, this creates suspense as you know there is going to be death but you just dont know who. A recurring Idea through out these short stories is that physical attraction is stronger than motional attraction. This idea is portrayed in The Visitor through Uncle Oswald. Uncle Oswald has never gotten married and is never with the same woman for too long. He has the ability to seduce woman through his physical features. This is shown because when Oswald was aroused, something odd would begin to happen around the edges of his nostril holes and revealed whole areas of the bright red skin inside. This created a queer, wild, animalistic impression, and although it may not sound particularly attractive when described on paper, its effect upon the ladies was electric. (Dahl Vol. 1 292) The idea that physical attraction is more powerful than emotional attraction is shown in the story Mrs. Bixpy and the Colonels Coat through both Mr. and Mrs. Bixpy. The emotional attraction between them both is weaker than the physical attraction between themselves and their lovers. Evidence of this is the mink coat that Mrs. Bixpy received from the Colonel. When Mrs. Bixpy tried to manipulate Mr. Bixpy into getting the coat for her in the pawnshop, He cared more about Miss Pulteney, his secretary, than he did his own wife. The idea that physical attraction is stronger than emotional attraction is portrayed in Ninc Dimittis when Janet de Pegalia told Gladys Ponsonby that Lionel Lampson was a crashing boar. By her saying this, she was expressing her dissatisfaction for the physical appearance of Lionel. When Gladys Ponsonby drunkenly told Lionel about what she had said, Lionel got extremely offended and started to plot against Janet. This means that he highly prioritized his physical attractiveness over his personality. The whole plot of the story is thus put into motion by physical attraction. The emotional attraction that they had together was easily extinguished by the pure physical attractive feelings.

Mutual Mistake Essay

Abstract Mutual Mistake of fact is when both parties of a contract make an assumption of fact when contract is formed and signed. The mistake must significantly change what you have to do under the contract, almost to the point where it’s an entirely different agreement. Although, if you knew there was a strong chance or probability of mistake at the time the contract was signed, you may have assumed the risk of that mistake. You therefore cannot use the mutual mistake defense. Not all cases of Mutual Mistake are strong enough to void a contract. Contract Law: Mistake of Fact In the given case: Josh Hartly was interested in purchasing a new car and visits his local auto dealer. In the course of his negotiations, he tells the salesperson that he wants the car with a 3.2 liter V6 engine and not the one with a 3.9 liter engine because he has concerns regarding the fuel economy of the 3.9 liter engine. Josh then signs a contract agreeing to purchase the car with a 3.2 liter V6 engine. What neither Josh nor the salesperson knew was that the manufacturer had already stopped manufacturing both the 3.2 liter and the 3.9 liter engines, and was equipping the cars with a newly designed 3.5 liter engine. This is a mutual mistake of fact that makes the signed contract void due to the lack of knowledge by both parties that the manufacturer had stopped making the cars with either a 3.2 liter or a 3.9 liter V6 engine and now only makes a 3.5 liter V6 engine for there cars. Someone trying to avoid his or her obligation under a contract can raise a mutual mistake defense. The defense states that both parties to the contract relied on a mistaken assumption when entering the contract, which then makes the contract void. A mistaken assumption is a fact that both John Hartly and the auto salesman believed to be true at the time the contract was signed, in this case the fact in question was that John Hartly was to receive a car with a 3.2 liter V6 engine. However, due to the manufacturer discontinuing production of the 3.2 liter engine, this fact is no longer true. As a result, the salesman can no longer perform the contract as he originally intended. (LaMance, 2011) It is absolutely agreeable that in these types of situations that a contract be deemed void from a mutual mistake of fact. If, for example, someone was contacted to dig a whole in someone’s backyard but after the contract had been signed both parties had found out that under a thin layer of dirt was solid rock, a mutual mistake of fact could make the contract void since neither party knew of the rock under the surface. If a mutual mistake defense was not possible then the person contracted to dig the whole would have to dig the whole under any circumstance and run the risk of destroying their equipment and/or having to spend more money for equipment capable of doing the job. In the case of John Harlty neither party acted unethically. Though one could argue that the salesperson should of known that the manufacturer was to stop production on cars with either a 3.2 liter and 3.9 liter V6 engine and begin production on a new model with a 3.5 liter engine before trying to sell a discontinued car to a customer. This would make it a unilateral mistake of fact because the salesperson had a reason to know of the mistake and it was his fault that led to the mistake (Emanuel, 2011). But, on the other hand, buying a new car is a pretty big deal and the potential customer should have done their own research and found out that a certain model of car was to be changed in the coming weeks, months, years, or however long it was until the change. The Uniform Commercial Code or UCC is a model statute that has been adopted by every state in the United States in its entirety. The UCC is most often used to resolve contract disputes for the sale of goods (LaMance, 2013). The UCC only deals with merchants, which is defined as anyone with a special knowledge in a given commercial field. Therefore, a sale of goods between two private, non-merchant parties will not be subject to UCC requirements (Rivera, 2013). In terms of winners and losers, there are no winners. One could say that the winner would be the buyer because they won the defense of mutual mistake of fact but they are still with out what they were trying to buy in the first place. Hamlet and His Delay in Seeking Revenge Against Claudius...

Zikima Sawyer English 102:002 Professor Hayes November 11, 2011 Hamlets Delay In William Shakespeare, Hamlet, the ghost speaks to Hamlet, claiming to be his father’s spirit. Hamlet is shocked at the revelation that his father has been murdered, and the ghost tells him that as he slept in his garden, a villain poured poison into his ear, the villain who now wears his crown, Claudius. The ghost urges Hamlet to seek revenge, telling him that Claudius has corrupted Denmark and Gertrude, taken her from the love of her first marriage and seduced her in the lust of their incestuous union. The ghost also urges Hamlet not to act against his mother in any way. Claudius has done this by dispatching Cornelius and Voltimand to Norway, the two men exiting after pledging their loyalty (Line 40) . On the other hand, in his first soliloquy, Hamlet expresses unhappiness and wishes he could commit suicide since the uses of this world have become weary, stale, flat, and unprofitable to him but Hamlet quickly reprimands himself for such thoughts, they are like weeds in a garden and a sin (Lines 132-136). Hamlet is in fact depressed about the death of his father and marriage of his mother. Despite Denmark is in a state of high alert and Claudius is preparing for possible war with Fortinbras, Hamlets depression supersede being fit to be King of Denmark. Hamlet confesses that his father was so loving to my mother that he might not betweem the winds of heaven visit her face too roughly(Line 140) and yet â€Å"within a month†(Line153), his very own mother remarried Claudius. Hamlet continues angrily as to generalizes that all woman like his mother are weak when he says, Frailty, thy name is woman(Line 146)!
